Amending Ordinance entitled Town of Kennan Zoning Ordinance
The Town Board of the Town of Kennan pursuant to its authority under Sections 60.62, 61.35, and 62.23(7) Wis. Stats. does hereby amend the Town of Kennan Zoning Ordinance and does ordain as follows:
Section 3.17 Special Exceptions is hereby created as follows:
Minimum property line setbacks and minimum road setbacks established by this Ordinance may be reduced by Special Exception upon approval by the Town Board. Reduced shoreline setbacks shall not be considered under this section and shall be subject to the provisions of Section 8 and any applicable County Shoreland Zoning regulations. This section applies in all zoning districts.
- Procedure
- Any property owner seeking a Special Exception shall submit an application on a form provided by the Zoning Administrator and pay the required nonrefundable fee established in Section 4.10.
- Upon receipt of a complete application, the Zoning Administrator shall provide written notice to all adjoining property owners and shall forward the application to the Town Plan Commission for review.
- The Town Plan Commission shall hold at least one public hearing on the application. Notice shall be published as a Class 2 notice under Chapter 985, Wisconsin Statutes.
- Following the public hearing, the Plan Commission shall make written findings and a recommendation to the Town Board.
- The Town Board shall approve, approve with conditions, or deny the application.
- If approved, the Special Exception shall be recorded with the Price County Register of Deeds at the applicant's expense and shall run with the land unless terminated pursuant to this section.
- Termination: A special exception granted shall automatically terminate 12 months from its date of issuance if the authorized building activity has not begun within such time.
- Reconsideration
- No appeal or application which has been dismissed or denied shall again be considered unless the applicant can show a material change in circumstances.
- No rehearing shall be held except upon the affirmative vote of a majority of members of the Town Plan Commission upon finding that substantial material new evidence is submitted which could not reasonably have been presented at the previous hearing. Requests for rehearing shall be in writing and shall state the reasons for the request and be accompanied by necessary data and diagrams. A rehearing shall be subject to the same notice requirements as original hearings.
- Section 4.10-Fee Schedule is hereby repealed and recreated as follows:
